Essential information on your legal rights as an ODSP recipient, medical reviews, reporting household changes, asset limits, and free legal aid resources.
Your Core Rights Under ODSP
- Right to Written Decisions: You must receive a written decision letter explaining any change, reduction, or cancellation of your benefits.
- Right to Appeal: You have the right to request an Internal Review and appeal decisions to the Social Benefits Tribunal.
- Right to Respect & Privacy: Caseworkers must treat you with dignity and respect your personal health privacy under FIPPA.
- Right to Representation: You can have an advocate, friend, or legal worker represent you in meetings or hearings.
Navigating ODSP Medical Reviews
Many ODSP approvals come with a scheduled Medical Review Date (e.g. 2 or 5 years after approval).
When you receive a Medical Review package, you have 90 days to complete and return it with medical evidence from your treating healthcare provider confirming your condition persists.
Asset Limits & Exemptions
ODSP allows recipients to build financial security while maintaining eligibility.
$40,000 Single Asset Limit
Single recipients can hold up to $40,000 in non-exempt savings, bank accounts, or investments ($50,000 for couples).
100% Exempt Home & Car
Your primary residence and one primary personal vehicle do not count toward your asset limit regardless of market value.
RDSP & Gifts Exemption
Registered Disability Savings Plans (RDSPs) are 100% exempt. You can also receive up to $10,000 in voluntary gifts per 12-month period.
