Understanding Windfalls and ODSP Asset Limits

Receiving a lump-sum inheritance, court settlement, or financial gift is a major event. Under ODSP policy, single recipients have a standard $40,000 asset limit (higher for couples and dependents).

If a sudden windfall pushes your total liquid assets above your limit, your benefits could be suspended unless you utilize approved exemption pathways.

Key Exemptions & Strategies

1. The $10,000 Annual Gift Exemption

ODSP policy allows recipients to receive up to $10,000 in voluntary gifts or payments from family, friends, or estates in any 12-month period without any reduction in monthly income support.

2. Absolute Discretionary Trusts (“Henson Trusts”)

A Henson Trust is a legal trust structure where the trustee has absolute discretion over when and how funds are paid to the beneficiary. Because the recipient does not legally control or own the trust principal:

  • The entire capital in a Henson Trust is 100% exempt from ODSP asset limits with no cap.
  • Income distributed from the trust for disability-related items or within annual gift limits remains exempt.

3. Transferring Inheritances Directly to an RDSP

Inheritances and life insurance proceeds from deceased parents or grandparents can be rolled over directly into an RDSP up to the lifetime limit ($200,000). Funds placed in an RDSP become completely exempt from ODSP asset calculations.

4. Purchasing Exempt Primary Assets

If you receive a lump sum, ODSP rules permit you to convert liquid cash into exempt assets within reasonable reporting windows:

  • Primary Residence: Buying a home or paying down a mortgage on your primary residence.
  • Primary Vehicle: Buying or modifying a vehicle needed for personal transportation.
  • Disability-Related Items: Purchasing medical equipment, home accessibility modifications, or specialized assistive technology.

Always report any inheritance, legal settlement, or gift to your ODSP caseworker by the 7th of the following month. Transparency combined with proper legal structures protects your benefits completely.
